The subject of pharmacy law is essential to pharmacy practice, but the resources in this area available to students, practitioners, and academicians are limited. Pharmacy Practice and the Law is a textbook that attempts to fill the void of quality, easy-to-read, pharmacy law resources. This book is designed for students in a pharmacy law course, but the material contained in its 8 chapters is relevant to all practitioners, regardless of practice setting.
As in earlier editions, this book focuses primarily on federal laws and regulations that govern medications and the practice of pharmacy. The text begins by providing an overview of the legal system and how laws are enacted. After providing a brief, chronological description of some of the major federal pharmacy laws, considerable attention is spent on the Controlled Substances Act. The book concludes with a chapter on pharmacist malpractice and ways to limit liability with risk management strategies.
The topic of state law is addressed in one chapter. This is a difficult area to cover in any text, given that each state can, and often does, enacts its own laws. Furthermore, it would be practically impossible for a book to include the laws of each state within its contents. In the chapter on state regulation of pharmacy practice, the text discusses the functions of state boards of pharmacy and the procedures employed in disciplinary actions against a pharmacist.

At the end of each chapter is a section of case studies that are excerpts from actual court cases. These illustrations are particularly useful in that they provide “real world” examples for the particular law or regulation in question. The text also does a fairly good job of including important holdings from court decisions throughout the readings to reinforce certain legal principles. However, if there is a shortcoming in this text, it is the selection of several examples that are included in the case studies. Many of the cases at the end of the chapters are not as relevant and applicable as they could have been. Given the continual dynamic nature of the law, there were better examples that could have been included. Still, the fact that cases are included in the text makes this a very good educational resource.

When designing a text covering legal principles, it is tough to know which legal provisions, if any, should be included. Reading the actual language of a law that contains many pages is a challenging and often frustrating task. However, omitting all this language does a disservice to the reader in that the actual law itself is never presented. This book strikes a nice balance in that certain essential provisions are included but not to the point of overwhelming the reader. With the interpretation given, it is easy to understand the law and how it impacts pharmacy practice.

Overall, I highly recommend Pharmacy Practice and the Law for inclusion in any pharmacy law class. I have used this text in my pharmacy law course for several years and have found that it provides a great foundation for my students. The language of the text is written so that a legal background is not required to understand it. Furthermore, the use of multiple case examples helps illustrate essential legal principles. Though I would recommend both expanding the book's section on state board inspections and adding a section regarding the Multistate Pharmacy Jurisprudence Examination (MPJE), I have found this resource to be an essential text for introducing students to pharmacy law.
